Terms and Conditions

By placing an order with 1893 Engraving LLC (the “Company”), you certify that you have read, understood, and agree to the terms outlined below. If you have any questions about this Service Contract (the “Contract”), please contact us at 1893info@gmail.com.

Definitions

  • Company: 1893 Engraving LLC and its affiliates.
  • Content: All materials provided by the Client, including text, images, and photos.
  • Services: Engraving, embroidery, and woodworking services, including Basic and Custom Engraving.
  • Client: Any person or entity placing an order with the Company.
  • Goods: Property provided by the Client for Services.
  • Materials: Design elements (e.g., logos, text) to be embroidered or engraved on Goods.

1. Submission of Materials and Approval of Proof

For Custom Services (engraving, embroidery, or woodworking), the Company will provide a proof for Client approval. Upon approval, the Client’s payment becomes non-refundable.

2. Payment for Services

Payment for Services is due in full at the time of order, unless otherwise agreed upon for Custom Services (50% upfront).

3. Intellectual Property

The Company’s website and marketing materials are protected by copyright. Unauthorized use of these materials is prohibited.

4. Indemnification

The Client warrants that they have the right to use the Materials and will indemnify the Company for any claims arising from infringement or misuse of intellectual property.

5. Manufacturer Warranties

The Client is responsible for understanding the warranties for Goods they provide. The Company is not liable for any voided warranties due to Services provided.

6. Disclaimer and Limitation of Liability

The Company provides Services “as is” and disclaims all implied warranties. Liability is limited to the total invoice amount for Services provided, excluding damages like lost revenue or Goods damage.

7. Waiver

Failure by the Company to act upon a breach does not waive its right to act in future instances.

8. Company’s Right to Decline

The Company reserves the right to decline any order at its discretion.

10. Binding Effect

This Contract is binding upon the Client and their representatives. Any amendments must be in writing and signed by the Company.

11. Governing Law

This Contract is governed by the laws of the Commonwealth of Virginia, and any litigation will occur in Virginia Beach, Virginia.

12. Waiver of Right to Trial by Jury

Both parties waive their right to a jury trial for disputes arising from this Contract.

13. Gender and Number

Pronouns and numbers may be adjusted as needed for clarity.

14. Assignment

The Client may not assign this Contract without the Company’s written consent.

15. Company Legal Action

In the event of legal action, the Company is entitled to recover reasonable attorney’s fees and costs.

16. Severability

If any provision is deemed unenforceable, the remainder of the Contract will remain in effect.
